DUI Laws in Washington

In Washington, a driver faces misdemeanor DUI charges if the results of a chemical test show they had a blood alcohol concentration (BAC) of .08 or higher, or if they drove while under the influence of alcohol and/or drugs regardless of their BAC.

A first-time DUI conviction could result in severe penalties, including jail time for up to 364 days, a fine of up to $5,000, and driver’s license suspension for 90 days. The penalties can increase for subsequent convictions, or if the driver caused a DUI accident that resulted in injury or death of another. Additionally, the charge could be increased to a felony if the individual was convicted of 3 or more DUIs within 10 years.
